Problem: A client employer was accused by an employee of violation of various employment laws, including the Federal Fair Labor Standard Act and the Illinois Wage Payment and Collection Act. These statutes have onerous fee-shifting and penalty provisions, even for minor technical violations.
Resolution: In order to minimize client exposure, partner Christopher Kennedy devised a cost-effective litigation strategy. The case was quickly resolved through a favorable settlement on behalf of our client. (The settlement terms are confidential.) In addition, he advised the client in how to avoid similar problems in the future.
