Case Study – Litigation/Construction Litigation

Problem: Our client, a general contractor for a municipal sewer project, was a defendant in a dispute with a subcontractor over the terms of an agreement. The subcontractor and the general contractor disagreed over the scope of the work and whether the subcontractor’s work was completed according to specifications.

Resolution: After failed negotiations between the parties, partner Christopher Kennedy defended the contract claim and pursued a counter-claim against the plaintiff on behalf of the general contractor. The judge ruled completely in our client’s favor; the plaintiff failed to prove a basis for a contract claim.
